Resolution No. (111), dated 1438H

 

The Chairman of the Board of Grievances, the president of the Administrative Judicial Council, after reviewing the Commercial Court Law, issued by the Royal Order No. (32) dated 15.01.1350 AH, and the Law of procedure before Shari'ah Courts, issued by the Royal Decree No. (M / 1) dated 22.01.1435 AH, and the recommendations of the work team formed under the resolution No. (43) dated 1438AH, subject of studying the improvement of the Kingdom's competitiveness in the Contracts Enforcement Index, dated 22.03.1438 AH, and the relevant study prepared thereon, and the Administrative Judicial Council resolution No. (10/1438 / twenty four), In authorizing the chirman of the Bog to take the necessary action, regarding the aforementioned recommendations,

 

Decide the following:​

1.      When filing any commercial lawsuit, the Litigation department shall determine the hearing of the case within a period not exceeding (20) days from the date of filing. The following day, the defendant shall be informed about the lawsiut with a copy of the claim memorundum and its relevant documents, as well as the date of the hearing session, also submitting the reply memo at the said department.

 

2.      During the hearing, the court shall verify the jurisdiction and acceptance. The court shall rule if the case is valid for ruling. The hearing shall not be adjourned except for a reason to be proved in its court record. The hearing shall not be postponed more than once for the same reason, related to either party. The hearing sessions shall not be more than three.
 

3.       If the Court adjourned the hearing, in accordance with the previous article, then it will enable the parties to exchange the memorandums before the next hearing at the said department, not exceeding two memorandums for each Party, and within periods not exceeding two weeks each.
 

4.       This resolution shall be enforced after thirty days from its issuance date.
